I want an attorney – but how do I prevent my spouse from thinking I am out to get them?Answer"I've hired an attorney" is a sentence that strikes fear into the hearts of many. However, divorce is a legal process and parties are almost always better off to have attorneys advise them during a divorce. Attorneys can make certain that the judgment entered in court is consistent with the parties' intentions and that there are not unintended legal effects. How the spouse is introduced to divorce proceedings is extremely important. Many wasteful, spiteful divorces could have gone much more smoothly if the spouse was properly introduced to the initiation of the divorce. Getting served with a Summons is usually not the best way to get things off on the right foot. One of the first issues I discuss with a divorce client is how to best approach the spouse with the issue of divorce so both parties can make reasoned decisions on how to best proceed. Category |
