How can I be sure my Will is enforced upon my death in the case of my pet’s care?

Answer

In Illinois, the legislature has enacted a statute that states that a trust to care for domestic animals is valid and terminates upon the death of the last named animal.  This means that you may create a trust in your Will that provides money to care for your pet or pets and it will be enforced.  You should also designate a trustee and a guardian for the pets and set out any other instructions, such as health care, that are important to you.

It is imperative that your Will or trust language conforms to the legal requirements for enforceability.
