I feel like a prenuptial agreement starts the marriage off on the wrong foot – why should I do it?

A prenuptial agreement is useful in some marriages and unnecessary in others. A fairly negotiated prenuptial agreement can start the marriage off on the correct foot by the parties openly discussing their values and concerns and coming to agreement on these issues.

Also, a prenuptial agreement can protect assets from garnishment by a previous spouse by specifying that certain assets are non-marital property.  A prenuptial agreement allows you to specify what assets are yours, what assets are your spouse's, and what assets are marital property.  These classifications are critical in determining where assets are allocated during a divorce or in the event of your or your spouse's death.
